Terms & Conditions
In the following terms & conditions “the photographer” shall mean Shantha Delaunay trading as Shantha Delaunay Photography. “The client(s)” shall be those persons making the booking and specified in all correspondance. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.
Copyright of all images belongs solely to Shantha Delaunay Photography and is protected by the French Copyright Law. It is illegal to copy, scan, print or reproduce these images in any way without a written permission from the photographer if you are not a client.
If you are a client and wanting to use the images for commercial purposes, please have written consent from the photographer before doing so. Otherwise, the client has full user rights which means that images may be used for sharing on social media, with family and friends.
The photographer shall only make reproductions for clients or for use in the business' portfolio, advertising, samples, albums, social media and website. The photographer also has the right to enter images into photographic competitions, art exhibitions and publications.
No fees, royalties or payment of any kind will be owed in connection with any usage made of any image captured or created by the photographer.
There may be circumstances where you may wish for your images not to be used for any of the above purposes. Please inform the photographer if this is the case before your photoshoot date and your wish will of course be respected. This will not compromise the quality of your photo session nor the image quality. However, this release of usage rights means that the client owns the full rights to the images and this will be at a cost of 500euros due to the photographer.
Force Majeure or Act of God
The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend the photoshoot date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.
These Terms and Conditions shall be governed and construed in accordance with the Laws of France.
The Photographer shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our clients arising from delay in transit. Where work is defective for any reason, including negligence, the photographer's liability (if any) shall be limited to rectifying such defect.
In the event that photographic materials are lost or damaged, without fault on the part of either party, the limitation will also apply. In such cases, the photographer is not liable.
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
The Photographer shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The Photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.
All image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct.
Only digital images are provided at the moment in high resolution JPEG format only.
